This website is owned and operated Emma-Louise Grinsted of 15 West Street, Corfe Castle, Dorset, BH20 5HA, United Kingdom.

Terms such as “I”, “me” and “my” and the names Elouisa and elouisa.art all refer to me, Emma-Louise Grinsted, where they are used in this policy.

By using my website as a website visitor or customer, you agree to be bound by the terms and conditions of this policy.

These terms and conditions are valid for any order placed on this website. I do not accept other terms and conditions by you. I reserve the right to change these terms and conditions at any time and it is your responsibility to check before ordering.

Product details

I take great care to make sure that the details displayed for each item offered for sale are correct at the time when the information was entered onto the system.

Whilst I take every care ensure that I show as accurately as possible the appearance, colour, texture or finish of my work, your computer monitor or equipment may display the images differently, so I can’t guarantee that my images are an accurate representation of the actual work that you are purchasing.


Online orders

All orders placed on this website are binding on your behalf. When you place an order via my website, I will treat that as an offer to buy.

All orders received via the website will be acknowledged by a system generated order confirmation e-mail. If you haven’t recieved a confirmation e-mail I might not have received your order, so please contact me to check that your order was sucuessful.

I might not be able to accept your order for various reasons, including:

  • The item you have ordered is out of stock
  • I can’t authorise your payment or I have reasonable grounds to suspect your payment may be fraudulent
  • There has been a pricing or product description error
  • There is a system failure

If I am unable to accept your order due to lack of stock or pricing or product description errors, you will be contacted via e-mail to arrange a refund or replacement.

Although you will recieve a system generated order confirmation e-mail when you place an order, this email is not confirmation that your order has been accepted, as your order isn’t accepted until your goods have been dispatched.


Refunds on cancelled orders

If you want to cancel an order please contact me immediately to find out if the items have been dispatched or not. If they have been dispatched you will need to return the item. You will unfortunately be responsible for paying the cost of returning the items.

If you cancel an order before it has been dispatched then you will recieve a full refund including postage and package costs.


Returning faulty items

If the item you purchased was faulty or did not work properly, or you think the item was not as described in the item description, please contact me first before requesting a refund as I may be able to resolve your problem to your satisfaction.


Returns & refunds

Under the Consumer Contracts Regulations, if you change your mind about a purchase you have made within 7 working days after the date of delivery, you are entitled to a full refund of the original purchase price and the original postage and packaging charges. Unfortunately, you aren’t entitled to a refund of the cost you incur in returning the item.

Some types of goods are exempt from being returned for a refund where they are handmade, specially commissioned or personalised goods.

Returned items must be unused and in the same condition that you received them, and they must be in the original packaging.

If you would like to return an item you have purchased, please contact me to let me know that you will be returning the item.

If an item was purchased with a discount voucher, then I can only refund the amount that you paid.

If an item was purchased in a sale then it may not be eligible for a refund if you have changed your mind. If you are in any doubt please contact me before making the purchase.


Website Misuse

Please do not misuse my site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. Please do not attempt to gain unauthorized access to my site, the server on which my site is stored or any server, computer or database connected to my site. By breaching this provision, you would commit a criminal offense under the Computer Misuse Act 1990. I aim to report any and every such breach to the relevant law enforcement authorities and I will co-operate with the relevant law enforcement authorities by disclosing your identity to them.


Liability & Indemnity

I shall not be liable for any direct, special, indirect or consequential or incidental damages including loss of profit or loss of opportunity as a result of the use of or the inability to use any items that have been ordered on this website.

You agree to indemnify me and my agents, officers, directors and employees, immediately and on demand, against all claims, liability, damages, costs and expenses, including legal fees, arising out of any breach of any of my terms and conditions.


General

These terms and conditions shall be governed in accordance with the laws of England and are subject to the exclusive jurisdiction of the courts of England & Wales.

These terms and conditions do not affect your statutory rights.
